Yeah, but what they've done over the last few year is try to make it a much safer 'buying' environment after lots of fraudulent sellers - it's much harder as a seller now to win any cases, they almost always find in the buyers favour....

Have you got a copy of the original listing? If he didn't state the deposit was non-refundable you should have a case againt him I reckon.
To be honest even if he did say it was (non-refundable) the amount you paid only to be then faced with being arsed about would tip in your favour.
If you have kept any correspondance from him (e-mails, messages through 'My eBay' etc) then these will help you a lot.
I'd also consider reporting him to Trading Standards because even if there isn't much they can do they will certainly make a note of him and if he does this sort of thing repeatedly then they should nail him for it.
Also he's a trader of some sort so that will definately go in your favour. The best thing I can suggest is to get him to a small claims court, ideally one near you if you lives miles from him as he's probably less inclined to turn up then, which does you a favour.
*I've just seen on the last listing for that BX he asked for a £100 deposit, and it does not state it's non-refundable.

When I agreed to buy it from him it wasn't through eBay, it was just via his advert on this forum. So yes - eBay is generally toothless on this sort of thing, but in this case I wouldn't be at all surprised if they didn't really care. To be fair I can't blame them for that.
When we first talked about buying the car he said that it wouldn't be a problem for it to sit up there as he had plenty of room for it, as long as I gave him some money. He suggested half would be appropriate, which to be honest is a bit more than I would usually give someone as a deposit but I agreed because I really liked the look of the car.
It was only when I actually suggested a pickup date to him (and it's not as if it's months away, in fact the date I suggested is only a couple of weeks away) that he decided he would need the rest of the money by the 19th or he would consider I did not require the car (I quote).

Gibbo2286 is right in saying that the police probably won't act as this is a civil debt, but if you know this idiot's actual identity, would you please report it anyway?
They probably have intel on him already and anything you can add might be part of a jigsaw for a bigger pattern of crime, if he's a regular fraudster.
